Dispute, Delay, Dilute: Lessons from Kellogg’s v Government

On 4 July 2022, the High Court of Justice conclusively dismissed the challenge that Kellogg’s had mounted against the Promotions and Placement (England) Regulations 2021. In particular, the Court confirmed that the Government had not exceeded its powers and that the Regulations were both proportionate and rational as part of the Government’s strategy to tackle obesity. This decision, which represents a significant victory for public health, contains interesting lessons.

This event will be roundtable discussion to better understand the implications of this judgement for the development and implementation of legally binding measures intended to prevent obesity and diet-related diseases in the UK and beyond. It will also consider legal and other industry influence on public health policies from other countries, including recent decisions to delay implementation of other policies to restrict advertising and price promotions of less healthy food.

Participation is by invitation only, and the discussion will be conducted on the basis of Chatham House rules to promote as open and constructive an exchange of views as possible amongst participants.
